# Terms of Service

Last updated October 16, 2026

Lawyer review pending. This document was drafted in plain English and has not yet been reviewed by a lawyer. It will be replaced by the reviewed version.

These terms are between you (the business that keeps a website or uses our services) and Caribeam Inc., trading as Kohmera (“we”, “us”). By subscribing, or by accepting a quote from us, you agree to them.

## 1. What we provide

We build a website for your business and show it to you as a private preview before you pay anything. When you subscribe, we launch the site on your own web address, host it, keep it secure, keep it online and keep improving it for as long as your subscription is active.

We also offer automation and bookkeeping services. Those are described in section 8.

## 2. What the website plan includes

The Kohmera Website plan includes the website, hosting, a security certificate, saved copies of every version, a site that works on phones, connecting your own web address or registering a new one for you (see the Web address terms), setup for search engines and AI assistants, privacy-friendly analytics, performance monitoring, and ongoing care: routine changes when you ask for them, improvements when visitor data or your business gives a reason, and keeping the design current over time.

Routine changes are included with no fixed monthly limit. A routine change is an update to your existing website: hours, prices, photos you provide, wording, a new service, a new team member, a promotion, a testimonial, a new location, a new page in the existing design or a better call to action. Fixing a change we made, or anything we got wrong, is always included.

Fair use. The plan covers one website of normal size for one business. We may group or schedule large batches of changes over several days, and we tell you if a request goes beyond routine care. We keep the design current as standards change, at a pace we judge sensible; a complete redesign at your request is quoted, except the free one described next.

Prefer a different look? Ask within your first 30 days and we build you one brand new design from scratch, free, for the same business.

Work that is not routine care is quoted before anything starts, and nothing starts until you agree. For example: an online store, a booking or payment system, customer accounts, custom software or applications, significant connections to other software, a second website, a new brand, or writing a large set of new content.

Add-ons are not included in the plan. Each one has the monthly price listed on the Pricing page when you choose it (Book online, 24/7: $19; Quote requests with photos: $9; Deposits when they book: $15; More Google reviews, less asking: $19; Bring past customers back: $29; Google Maps profile, done for you: $29; A page for every town you serve: $19; Your site in French or Spanish: $19), is added to your subscription only when you choose it, and can be dropped at the end of any month.

## 3. Price and billing

The price is $49 per month, charged in Canadian dollars for businesses in Canada and in US dollars everywhere else. The currency is shown on your claim page and on your receipt. Monthly subscriptions renew each month. Payment is handled by Stripe; we do not store card numbers. Prices can change with 30 days’ notice by email, and a change never applies before your next renewal. There is no build fee and no set-up fee.

You can pay yearly instead. The yearly price is ten months of the monthly price, so two months are free: $490 per year, in the same currency. If you pay a discounted monthly price, your yearly price is ten months of the price you actually pay. Yearly subscriptions renew each year.

You can choose yearly when you subscribe, or move to it later using the link in our email. Moving takes effect at your next renewal: nothing is charged on the day you ask, the month you have already paid for is not shortened, and you can change your mind at any time before that date by replying to any of our emails.

Automation and bookkeeping are priced separately from the website plan (see section 8).

## 4. Cancelling

You can cancel at any time by replying to any of our emails or from the link on your receipt. Your site stays online until the end of the period you have paid for, then comes down. There are no cancellation fees. Payments already made are not refunded except where the law requires it.

There is one exception, and it applies to yearly plans. If you tell us within 30 days of a yearly payment that you want to stop, we refund that payment in full and your site stays online until the end of the month you had already paid for. You do not have to give a reason.

## 5. Your content and ownership

The words, photos and facts on your site come from information you or your business made public, or that you send us. You own that content and you confirm you have the right to use it. Your web address stays yours (see the Web address terms). Enquiries and messages your customers send through your website are yours.

We own the code, layout and design of the site while you are a subscriber; the site’s files are not included when you leave. If you cancel, ask and we send you a copy of the photos, text and business information on your website. If you want a copy of the site itself to host elsewhere, you can buy one; ask us for the price.

## 6. Changes and improvements

Ask for a change in your Kohmera account at my.kohmera.com, by replying to any of our emails, or by writing to hello@kohmera.com. We confirm what we understood, a person on our team checks every change before it goes live, and we tell you when it is live, usually within one working day.

When we improve your website on our own initiative (for example moving a button visitors struggle to find), we tell you what changed. We never change your prices, services, claims or how your business is described without your approval.

## 7. Analytics

We measure how your website is used, in aggregate, to maintain and improve it: for example which pages are visited, where visitors come from and which buttons they use. We set it up to respect visitors’ privacy choices and the consent rules that apply where your business operates. We do not sell visitor data or use it for advertising.

## 8. Automation and bookkeeping

Automation. Custom automation work is described and priced in a written quote before it starts. Ready-made fixes have the monthly prices listed on the Pricing page. Automations depend on the other software they connect to; if that software changes or becomes unavailable, we fix what we reasonably can and tell you.

Bookkeeping. Bookkeeping services are described and priced in a written quote before they start, as a monthly price and, where needed, a separate one-time cleanup price. Bookkeeping support is not tax, audit or accounting advice, and we do not prepare or file tax returns. You remain responsible for your business’s financial decisions, for approving and sending payments, and for the accuracy of the information you give us. We never ask for passwords; access is set up through your software’s own user or accountant invitations, and you can remove it at any time.

## 9. What we do not do

Email hosting is not included. We do not guarantee search engine rankings, a position in AI assistants’ answers, or a number of customers or leads. We build and maintain the site using current technical search and AI-discovery practices, and that is what we promise.

## 10. Uptime and outages

We host on Cloudflare’s network and aim for the site to be available at all times. Outages outside our control (Cloudflare, your domain registrar, the internet) are not something we can refund.

## 11. Portfolio

We may show your live site in our portfolio with its name and a screenshot. Reply “no portfolio” to any email and we will remove it within 7 days.

## 12. Ending the agreement

We may end the agreement with 30 days’ notice, or immediately if your site is used for something covered by the Acceptable use policy. Your web address always stays yours.

## 13. Liability

Our total liability for anything arising from this agreement is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits or indirect losses. Nothing here limits liability that cannot be limited by law.

## 14. Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Disputes go to the courts of Ontario.
